1. Agreement
These Terms of Use ("Terms") govern your use of the InfinityLog website and, where you become a customer, the InfinityLog software and related services provided by Softify BD Limited ("Softify", "we", "us"). By using the website or the product you agree to these Terms.
2. About InfinityLog
InfinityLog is a network-activity monitoring and log-management solution for Internet Service Providers. It is licensed to you and deployed on your own hardware, on-premises. A formal quotation or order confirmation, together with these Terms, forms the agreement between us.
3. Use of this website
You may use this website for lawful purposes and to learn about and enquire about our products. You agree not to misuse the site, attempt to disrupt it, or access it in any way other than through the interface we provide.
4. Licence and deployment
On purchase, Softify grants you a non-exclusive, non-transferable licence to use InfinityLog for your own network, for the deployment and subscriber tier set out in your order. The software runs on infrastructure you provide and control. You may not resell, sublicense, copy or reverse-engineer the software except as permitted by law.
5. Fees, installation and renewal
Pricing is per package as quoted, typically a one-time installation fee plus an annual licence and support fee for the subscriber tier you select. Fees are exclusive of any applicable taxes. Licences are billed annually in advance; access to updates and support depends on your licence being current. Specific commercial terms are set out in your quotation.
6. Support and updates
While your licence is active, we provide the support described in your order and make available updates and fixes we release for your version. Response times and scope depend on the support level you have purchased.
7. Logs, retention and BTRC compliance — your responsibility
InfinityLog runs on infrastructure you own and control and is a tool to help you capture and retain subscriber-activity logs. Responsibility for those logs is yours alone. In particular:
- Maintaining the logs is your responsibility — keeping the software running and correctly configured, ensuring your routers forward data to it, and providing sufficient, reliable storage, retention and backups.
- Any missing, incomplete, delayed, corrupted or lost logs are your responsibility, whatever the cause — including hardware or disk failure, insufficient storage, power or network loss, misconfiguration, or changes you make. Softify does not monitor your deployment and is not responsible for log loss or gaps.
- Meeting your regulatory obligations is your responsibility, including any Bangladesh Telecommunication Regulatory Commission (BTRC) requirement to retain logs for a mandated period and to produce them to the authorities on request. Deploying InfinityLog does not transfer that obligation to Softify and is not a guarantee of compliance.
- Softify BD Limited has no responsibility or liability for the capture, completeness, retention, availability, loss of, or failure to produce, your logs, or for any regulatory finding, penalty, fine or action relating to them.
You are responsible for periodically verifying that logging is functioning and that your retention and backups meet your obligations.
8. Your other responsibilities
- Providing suitable, secure hardware and network access for the deployment.
- Using the product lawfully and keeping your access credentials and servers secure.
- Handling the subscriber data the product captures in accordance with applicable law — as the operator, you are the controller of that data.
9. Intellectual property
InfinityLog, its software, design, documentation and the InfinityLog name and logo remain the property of Softify BD Limited. Nothing in these Terms transfers ownership of the software to you.
10. Warranties and disclaimers
We provide the product with reasonable skill and care. Except as expressly stated, the product is provided "as is". We do not warrant that it will be uninterrupted or error-free, that it will capture, retain or preserve every record without loss, or that your deployment will satisfy any particular regulatory requirement. Verifying that logging works and that your retention meets your obligations is your responsibility.
11. Limitation of liability
To the maximum extent permitted by law, Softify is not liable for indirect, incidental or consequential losses; for any loss, gap or corruption of logs or data; or for any regulatory penalty, fine or action, however arising. Our total liability arising out of or in connection with the agreement will not exceed the fees you paid for the product in the twelve months before the claim.
12. Term and termination
The licence runs for the period stated in your order and renews as agreed. Either party may terminate for material breach that is not remedied within a reasonable notice period. On termination you must stop using the software; provisions that by their nature should survive (such as intellectual property, log responsibility and liability) will continue.
13. Confidentiality
Each party will keep the other's non-public information confidential and use it only for the purposes of the agreement.
14. Governing law and jurisdiction
These Terms are governed by the laws of Bangladesh, and the courts of Dhaka have jurisdiction over any dispute.
15. Changes to these Terms
We may update these Terms from time to time; the current version is always published on this page. Material changes affecting existing customers will be communicated through your normal contact.
